RE: Berm Project
The undersigned members of the Buckingham Community Association, Inc. request that the Board of Directors of this association immediately determine the applicability of utilizing the Lee County Municipal Services Taxing/Benefits Unit (MSTBU) to take over the contracting and completion of the “Berm Project”.
From the information that we have been able to ascertain from Joshua Malo of the MSTBU, the following is provided to you (as has been provided previously) for consideration”:
- Mr. Malo said that the berm would be a qualified project for them to consider
- We'd have to first submit an informal petition, which 50% +1 of the homeowner's would have to sign- this is to describe the project, and what we're looking to do, and pay the $500 application fee
- This would allow them to solicit an engineer to do a cost estimate
- If we decide to move forward after receiving the estimate we'd have to then submit a formal petition from again 50% +1 of the homeowner's signing.
- They would then determine the cost per parcel or cost per linear foot (whichever works out best for us)
- They would then have to present it to the Lee County BOCC (he said if they receive 3 quotes that are all under $250k then it would be an informal solicitation to the BOCC, which is quicker than a formal solicitation if the quotes are over $250k)
- This would be done as a one-time project so the county's involvement would end once the project is completed.
- Payments for the MSTBU project can be one time or over time with tax bill (with interest charges).
The survey information about the 17 perimeter lots that Lennar sold homes on must be ascertained and added to the survey information that the association already has. If this requires the association to pay the surveyor for the information, then that course of action should be taken. A complete survey is needed A.S.A.P.
This solution utilizing the MSTBU would remove the “Berm Project” from the responsibility of the HOA and Board.
The initial fee of $500.00 and additional costs associated with polling the members is a small price to pay to “get this project under control”.
The Board must contact Lennar on a person to person level (no e-mail) to make sure that the added survey expenses will be required to be expended by the association (since Lennar has those lot surveys).
In the event that the Board does not desire to respond with immediate action on this matter, then the Board should organize and appoint a Special Committee to pursue the “Berm Project”. That committee shall be empowered to look into the possibility of utilizing the MSTBU and any arrangement that may determined applicable.
By doing nothing on the “Berm Project” during 2024, we understand that we are violating our present agreement with Lee County and as members do not want to be in violation.
